What is professional negligence?
There’s often time in your life where you need to take professional advice on matters. Professional negligence means bringing a claim against, or suing, professionals such as:

- insurance brokers
Unfortunately, poor or incorrect advice can result in serious consequences for you. All professionals are required by law to act with reasonable care and skill.
Negligence is an area of law (known in the jargon as one of the Law of Torts, or Tort Law). To succeed in a claim for negligence you need to show:
- The professional owed you a duty of care;
- There was a breach of that duty
- That breach caused you loss
- The loss is not too remote
This is the so-called legal test for negligence in the UK.

How much do professional negligence claims cost?
Typically, quite a lot, I won’t beat around the bush.
However, we tend to act in professional negligence on a Conditional Fee Agreement (CFA) also known as a “no win no fee” agreement, although this is subject to terms, availability and an initial advice fee.
Very often, our clients have the benefit of Legal Expenses Insurance through their Home Insurance. We would recommend that you investigate whether you have any insurance which would cover legal costs.
