However, if the second lawyer takes 15 hours to do what the first lawyer take 10 hours to do, then the second lawyer is more expensive.

For this reason, I would always urge people to seek to agree either fixed fees or capped fees.

Fixed fees, which I almost exclusively work with, allow you to know exactly how much you will pay for a set amount of work.

Capped fees see the lawyer work on an hourly rate basis subject to a maximum cap.

I would never instruct a solicitor or law firm near you on a straight hourly basis, even if they have given you an estimate. 10% of all complaints against solicitors are about excessive costs – and these will almost always be where work has been done on an hourly rate basis.  If the law firm insists that hourly rates are the only way they work, and they are not prepared to give a cap on fees, then look elsewhere!

In addition to understanding the fee structure, ask what services are included in the quoted fees. Any good law firm should provide you will a full scope of works. For instance, does the fee cover all consultations, court appearances, and any necessary documentation? Knowing the full scope of what you are paying for can help you assess the value of the solicitor’s services.
